סדנת מומחים: Empirical Research of Balancing Rights and Public Interests

ב-6-7 למרץ 2016, התקיים בפריז סדנת מומחים בין-לאומית שכותרתה: Empirical Research of Balancing rights and Public Interests. הסדנה התקיימה כחלק מפרויקט המידתיות בקבלת החלטות שלטוניות, הנתמך על ידי מענק מחקר מאת ה-European Research Council. הפרויקט עוסק במצבים של עימות בין קידום תכליות ציבוריות לבין ההגנה על זכויות חוקתיות. פרויקט המחקר ניגש לעימותים הללו, לראשונה, מנקודת המבט של מקבלי החלטות, ועושה שימוש בשיטות מחקר ניסוייות בכדי לעמוד על ההיבטים הקוגניטיביים והתנהגותיים המשליכים על האיזון המתבצעים במצבים כאלה.
בהתחשב בחדשנות של שימוש במתודולוגיה אמפירית בהקשר הזה, מטרת הסדנה הייתה לכנס מגוון של מומחים ממדינות מוצא שונים ותחומי מחקר שונים, שלמומחיותם ישנה השלכות אפשריות להבנת תהליך האיזון הנדרש ממקבלי החלטות בעת גיבוש מדיניות במצבי קונפליקט אלו.
דיוני הסדנה סבבו סביב התמות הבאות: מושג המומחיות ביחס לשאלות נורמטיביות ומוסריות; פרדיגמות אפשריות לתאוריה התנהגותית של קבלת החלטות מינהלית; השפעות המסגור בעימותים בין אינטרסים ציבוריים לזכויות; עידוד היצירה וההשוואה בין חלופות בתהליך גיבוש המדיניות; ואתגרי הכימות והמדידה של המשקל היחסי של שיקולים מתחרים.
בסדנה השתתפו חוקרים מישראל, ארצות הברית, אוסטרליה, גרמניה ושוויץ, מתחומי הפסיכולוגיה החברתית, כלכלה התנהגותית, מדעי המדינה ומשפט.
את הכנס ארגנו פרופ' מרדכי קרמניצר, פרופ' יובל פלדמן, ד"ר רענן סוליציאנו קינן ועו"ד טליה שטיינר.
